He was finally extradited back to the U.S. after the NYPD lobbied the State Department.

Gadiyev and his alleged accomplice, Arsen Bashirov, are accused of beating the father in a parking garage near his Brighton Beach grocery store in Brooklyn back in March 2009.

The masked men ambushed him as he was carrying his payroll bag containing $34,000 in cash.

They used a hammer and hand axe to brutally beat Tolstykh before stealing the cash, two watches and a handful of Russian candy.

Tolstykh later died in hospital.

Police said Gadiyev and Bashirov were identified as the suspects from surveillance footage in the months after the killing.

But the two men had already fled to their native Turkmenistan, which does not have an extradition agreement with the U.S.

Gadiyev eventually made his way to Australia where he sought refugee status claiming that he was fleeing persecution in his native country for being gay.

Gadiyev was reportedly trying to officially change his name when he was arrested in 2014.

He lost his fight to remain in Australia last month. His co-accused, Bashirov, remains in Turkmenistan.
